Short-Term Rental Agreement
This Agreement applies to the reservation, including any approved modifications. The Guest is responsible for ensuring all occupants and visitors comply with this Agreement.

1. Use of Property
Guest agrees to use the Property for residential vacation purposes only and to comply with all applicable laws, HOA rules, and posted property guidelines.
Guest agrees to:
• Maintain the Property in a clean and orderly condition
• Avoid unsafe or disruptive behavior
• Respect neighbors and community standards
Any violation may result in immediate termination of occupancy without refund.

2. Occupancy, Age & Access
Occupancy may not exceed the approved guest count unless authorized in writing.
• No events, parties, or unapproved gatherings
• No subleasing or assignment
• The primary Guest must be at least 25 years of age and must occupy the Property for the duration of the stay
• Reservations made under false pretenses may be canceled without refund
Manager may enter the Property as reasonably necessary for maintenance, inspection, emergencies, or to address suspected violations.

3. Payments & Cancellations
A payment is due at the time of booking. The remaining balance is due 30 days prior to arrival and may be automatically processed using the payment method on file. Failure to complete payment may result in cancellation of the reservation without refund.
Standard Cancellation Policy
The following cancellation policy applies to all direct bookings:
• Full refund if canceled 30+ days prior to check-in
• 50% refund if canceled 7–30 days prior to check-in
• No refund if canceled within 7 days of check-in
A 48-hour grace period is provided for bookings made 14+ days prior to arrival, during which a full refund may be issued.
Processing fees, insurance, and administrative fees are non-refundable.
Major Disruptive Events & Natural Events
In the event of large-scale disruptions beyond Guest or Manager control, including:
• Public health emergencies
• Government travel restrictions or bans
• Natural disasters (including hurricanes)
• Widespread power outages or civil disruptions
Reservations may be eligible for cancellation or modification in accordance with applicable platform policies or local regulations.
For clarity:
• Hurricanes and named storm events are considered natural events
• Refunds or rescheduling related to such events will follow governing local authority guidance, mandatory evacuation orders, and applicable platform policies
• Voluntary cancellations due to weather concerns, personal scheduling conflicts, or travel disruptions (including flight cancellations or illness) are not covered under this policy
Travel Insurance Recommendation
We strongly recommend that all Guests purchase travel insurance to protect against unforeseen circumstances, including illness, travel delays, weather concerns, or other events not covered under this Agreement. Travel insurance is the best way to ensure reimbursement for situations outside of the cancellation policies outlined above.
Additional Terms
All cancellation policies apply equally to payments made by credit card, check, or other methods. Any eligible refunds will be issued to the original form of payment.

4. Property Condition & Maintenance
The Property is provided in its current condition (“as-is”).
Manager makes reasonable efforts to maintain the Property and its amenities; however:
• Temporary outages or inoperable items (including appliances, WiFi, pools, hot tubs, etc.) do not warrant refunds
• Conditions outside Manager’s control (weather, construction, utility interruptions, etc.) do not warrant refunds
Guest agrees to promptly notify Manager of any issues upon arrival. Failure to report concerns within a reasonable time constitutes acceptance of the Property.

5. Guest Responsibility & Damages
Guest is responsible for any damage, loss, or excessive cleaning required during their stay.
Manager may charge the Guest for:
• Repairs or replacement of damaged items
• Missing items
• Excessive cleaning or rule violations

6. Pets
Pets are only permitted in designated pet-friendly properties or with prior written approval. Unauthorized pets may result in additional charges or termination of the reservation.

7. Amenities & Use at Own Risk
All amenities, including but not limited to pools, hot tubs, decks, balconies, stairs, bunk beds, and outdoor areas, are used at Guest’s own risk.
Guest agrees:
• No glass or foreign substances in pools/hot tubs
• No pets in pools or hot tubs
• Children must be supervised at all times
• Surfaces may be wet, uneven, or slippery
• In-house fireplace is decorative only
•
Misuse may result in additional charges or removal from the Property.

8. Lost & Found
Items left behind may be returned upon request at Guest’s expense. Unclaimed items may be discarded after 30 days.

9. Manager as Agent
Manager acts solely as an agent on behalf of the Owner.
Guest agrees that:
• Manager is not liable for the condition of the Property except in cases of gross negligence or willful misconduct
• Any claims related to the Property itself are against the Owner, not Manager

10. Limitation of Liability
To the fullest extent permitted by law, Manager shall not be liable for:
• Injury, loss, or damage to persons or property
• Travel delays, cancellations, or interruptions
• Loss of use, inconvenience, or consequential damages
Manager’s maximum liability is limited to the amount paid for the reservation.

11. Indemnification
Guest agrees to defend, indemnify, and hold harmless Manager, Owner, and their respective members, employees, contractors, and agents from and against any and all claims, liabilities, damages, losses, and expenses (including attorneys’ fees) arising from:
• Guest’s use of the Property
• Acts or omissions of Guest or any occupant or visitor
• Violation of this Agreement
Except to the extent caused by Manager’s gross negligence or willful misconduct.

12. Safety & Assumption of Risk
Guest acknowledges that use of the Property and surrounding environment involves inherent risks, including but not limited to water features, weather conditions, outdoor elements, and structural features.
Guest assumes full responsibility for:
• All occupants and visitors
• Supervision of children
• Safe use of all amenities

13. Default & Termination
Manager may terminate this Agreement for violation of its terms. Guest must vacate immediately without refund.

14. Governing Law
This Agreement is governed by the laws of the state in which the Property is located. Any disputes shall be handled in the county where the Property is located.

15. Entire Agreement
This Agreement constitutes the entire understanding between the parties. Any modifications must be in writing.

Guest Acknowledgment
By booking or occupying the Property, Guest agrees to all terms outlined above and accepts full responsibility for all occupants and activities during the stay.
